Remember that you are not selling a product, you are selling a right to use a service. According to the EULA I do not own anything when I buy the game (unless you count the box, manual, the CD (not the software on it), and anything else inside the box). If I buy it from the in-game store I literally get nothing that anyone could say I own. If I do not own anything then where is this "product" you speak off?
I only have the right to play the game. A right to use the service.
If I am wrong here please someone explain it to me where the "product" is.

Sure I don't know all the laws and what not but there has to be a way you can do it since it happens everyday.
Here is an excellent example:
I can buy a plane ticket right now for a trip a month from now.
I WILL be charged RIGHT NOW the full amount of the ticket. In many cases you may have to buy the NON-REFUNDABLE ticket before you even get to see the times of your flights.
Can I use the ticket right now? NO
Can I change the ticket? maybe for a charge if it is allowed wherever you bought it from.
Can I get a refund for the ticket if i decide not to use it? Not from most places.
Do I own anything? Sure a piece of paper with some printing on it and only if I needed to print it out.
I payed NOW for a SERVICE that I can not use until later.
I see no difference.

Honestly I think it is awesome that some stores already have it available early regardless of the legal side of things. Too bad your legal department is too busy rewritting the EULA twice in the past week to figure out how this is possible.

Talked to the electronics department of where I work when I saw EotN on the shelf yesterday and was told that their paperwork said the retail release was the 29th. On the 28th I had seen the Pre-order boxes on the shelves still so I know that the floor was reset for the game its self being they have different prices and all.

Any REPUTABLE garage will do estimates for FREE!! I guess ANet isn't a reputable dealer.

I think all I'm gonna say is:

next go around, some firings and hirings need to be done. very poor communication. very.

it's sad when a company rep has to come to a fansite for release info. which they should already have.

I got the afternoon off work as they were training 3 newbs so had too many staff. I went into game, they had empty GWEN boxes on the shelf with £24.99 pre order stickers on and they had GWEN in the glass cabinet behind display.

So I went to the counter with a pre order box 'Can I buy this please'

Reply 'No we cant sell it untill tomorrow'

I were pretty much like WTF if you cant sell it untill tomorrow then why is it on the shelf and behind the counter?

Dumb people at game piss me off.

The real reason why Gaile asks this question with all due respect, is that she is collecting information about the retailers that sell early so that in the future those retailers do not get the product until weeks after release.

Funnily, I visited two stores (same company) one declined to sale whilst the other did. When I asked why the other store wasn't selling the game, he responded that the publishers might decide not to supply the retailer in the future if they are found to be selling prior to release date.

I don't, I am afraid, buy what Gaile said in her first post. Hence why I will not "snitch" on my local retailer. They have been good to me so far - atleast I don't have to wait till tomorrow to get a copy just before it goes live.

The guy at game told me that if they sell it before the release they can be fined £5000.

They make up a lot of lies to stop you from getting it early.

I'll have to buy in on the online store and download it on 384 kbps internet

Well I'm pretty upset at the moment. I just returned from Best Buy. They do not have the game in stock yet. I asked when it will be in and their best estimate is late next week.

Other Best Buys in the area already have the game on the shelves, but the one that I pre-ordered it from does not. I asked if I can pick it up from one of the other stores and they said no. I can only get it from the store I pre-ordered it at.

Grrr, wish I could just get a refund and run up to Gamestop and buy it.

I don't understand what difference it makes you can't play the game until you turn it on. So who cares who bought it where. Put it on the online store so we can buy it at our convience then we are ready to go when you open the gate.

You have a lot of problems with purchacing online with some credit card companies not wanting to take your business. An you will only let us use one credit card for one key per week. So one of my cards is no good to me because they think you are a credit risk. The other you will only let me use once a week. So tonight I have to decide which of my 3 accounts I want to play with and buy that at 12:01. The others will have to wait a week. Have you any Idea how many people are going to be trying to bu those keys at 12:01 tonight so they can get the mission pack. You are just asking for a big fat can of herring in a pile of nesting material. When you get a million grumpy customers tonight. Don't say we didn't tell you.

Ironically, with the delay in Australia and New Zealand the problem of too many people trying to buy in the ingame store is going to be compounded. We saw from Nightfall that the store can't handle that.
